US Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to answer human smuggling charges, he was detained in federal custody.
In her order, the court noted that the government does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
